Validity of Contract of sale
1.1 The terms of sale apply to the purchase of goods and services between the buyer (Buyer) and the company Elaan MTÜ (Seller),  Estonian business registry code 80334732, located at Kotkapoja 3-16, Kuressaare, Saare County, 93810 (VillaVolli) at www.villavolli.ee.
1.2. In addition to these Terms and Conditions, legal relations occur from the purchase of products from the VillaVolli Online Store shall be governed by the Law of Obligations Act (hereinafter LPA), the Consumer Protection Act (hereinafter TKS) and other legal acts in the Republic of Estonia.
1.3. By signing the order and making a prepayment at VillaVolli’s website, the Buyer confirms that he has read and agrees with the below VillaVolli Terms of Sale and the Processing of Personal Data.
1.4. MTÜ Elaan reserves the right to make changes in the terms of sale. These changes are posted on the website www.villavolli.ee

Prices
2.1 All prices shown in the e-shop are in euros. VillaVolli is not subject to VAT.
2.2 The cost of transport is added to the order’s invoice. It depends on the location of the Buyer, the method of delivery and the size of the parcel.

Ordering
3.1 Add desired products to the cart
3.2 Click on the “Make a Purchase” link and select the appropriate delivery method.
3.3 Fill in the fields on the data and order confirmation page carefully and click on the „Confirm“ Order’ link.
3.4 The Buyer will then receive an e-mail invoice with a fee for the delivery of the goods.
3.5 The Agreement is concluded from the moment when the payment made by the Buyer is received in the bank account of VillaVolli.

4. Shipping
4.1 Upon entry into force of the sales contract, VillaVolli will complete the order within 3 working days and deliver it to the company’s logistics partners for shipping.
4.2 Upon receipt of the ordered goods at the Smart / ItellaPOST or Omniva parcel terminals or delivery of the parcel by courier, the customer shall be informed by SMS / e-mail or by telephone.
4.3 If the goods arrive by post with the Omniva post office, the Buyer shall be notified by post.
4.4 By agreement, the Buyer may come to pick up the goods by himself at VillaVolli Studio in Tolli 7 II floor, Kuressaare, Saare County, Estonia.
4.5 In Estonia, the goods usually arrive within 3 to 7 days, depending on the destination.
4.6 If VillaVolli has handed the goods over to the logistics partner on time, the logistic company will be responsible for the delivery of the parcel.

5. Right of Withdrawal
NB! VillaVolli products is a hand-crafted art and design pieces of author’s work, which means that there is no stock in the store, and in small series of works can have little difference. For wet felting, we mainly use undyed wool from native Kihnu sheep, an Estonian breed with long traditions. Only the pattern used may be dyed and / or merino wool, the use of which has been disclosed in the description of the product. There is no industrial pre-felt in the items.
5.1 After the order has been received, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days.
5.2 The right of withdrawal does not apply if the Buyer is a legal entity.
5.3 When the 14-day right of return is exercised, the ordered goods may not be used. The goods can only be tested in the way they normally do in the shop.
5.4 To return the goods, you must submit an application for the withdrawal of the good. You can find the form here: https://e-kaubanduseliit.ee/wp-content/uploads/2015/01/JM_m41_lisa1.pdf and send it to info@villavolli.ee no later than 14 days after receiving the goods.
5.5 Please return the goods to the parcel terminal at Saare Selver in Kuressaare.
NB! The cost of returning VillaVolli’s goods will be covered by client.
5.6 Upon receipt of the goods, VillaVolli shall return to the Purchaser immediately, but not later than 14 days after the receipt of the withdrawal application, all the fees received from the Buyer under the Agreement.
5.7 VillaVoll may refuse to make refunds as long as the goods which have been the subject of the contract have been returned or the Buyer has provided proof of return.

6. Right of claim
6.1 VillaVolli shall be liable to the Buyer for any defect or lack of the Goods sold to the Buyer which existed at the moment of delivery of the item or which occurs within two years from the delivery of the Goods to the Buyer.
6.2 The Buyer shall have the right to contact VillaVolli at the latest within two months upon presentation of the invoice, by invoicing the purchase of the goods.
6.3 In case of non-conformity or defects of the product, please send an e-mail to info@villavolli.ee with the name of the ordering person, contact phone number, order number and exact description of the product’s non-compliance or defect.
6.4 If the goods are defective, please stop using the goods.
6.5 A claim for non-conformity or defect of a product shall be made within two months of the discovery of a defect in the product.
6.6 The repair or replacement of defective goods shall be agreed between VillaVolli and the Buyer. VillaVolli will cover the cost of the repair.
6.7 VillaVolli shall not be liable for defects caused by the Buyer due to improper storage, maintenance or non-intended use of the product.
6.8 All complaints shall be reviewed and contacted with the Buyer as soon as possible, but not later than within 14 days of receipt of the complaint.
6.9 If the Buyer and VillaVolli are unable to settle the dispute by agreement, the Buyer will be able to turn to Consumer Disputes Commission https://www.tarbijakaitseamet.ee/en/tarbijavaidluste-komisjon/kontakt or to the European Union Consumer Dispute Committee platform http://www.consumer.ee/

7. Processing of personal data
7.1. By entering data in the web shop and confirming it, VillaVolli has the right to collect and process the Buyer’s personal information (name, contact phone number, parcel delivery and / or home address, e-mail address) and forward personal data to the logistics partner for delivery of the goods.
7.2. VillaVolli has the right to use the address of the Buyer for the purpose of advertising and other information.
7.3. The Buyer shall have the right to prohibit the collection and use of his personal data at any time, unless this is necessary for the recovery of a claim under the contract or for the delivery of the goods.

9. Copyright
9.1 The content, including texts, graphics, logos, images, videos and audio of VillaVolli’s Store, is protected by copyright belonging to VillaVolli as a whole.
9.2 It is prohibited to reproduce, copy, modify or otherwise use the copyrighted content referred to in clause 6.1 without reference to VillaVolli.
